MLS players and owners (again) head to mediation over collective bargaining agreement

Mediation can play an important role in helping resolve legal disputes in a variety of cases, including family law, labor disputes, personal injury and construction disputes. In addition to helping resolve cases more quickly, meditation often involves significantly less cost for parties, especially parties who know how to engage in the process effectively and are committed to avoiding court.

That being said, mediation doesn’t work for all disputes or for all parties all the time. At present, some are speculating that an impending meditation involving the Major League Soccer (MLS) Players Union and MLS owners is not going to be able to overcome a stalemate over a new collective bargaining agreement. 

Major League Soccer is no stranger to collective bargaining disputes—the threat of a strike was present in the negotiation of the previous collective bargaining agreement. Both last time and now this time again, negotiations are going to be facilitated by the Federal Mediation and Conciliation Service, a federal agency which assists in mediating labor disputes. Mediators through the program are not selected by either party but are appointed by the government. Although the mediation program was successful in helping MLS players and owners reach an agreement back in 2010, it remains to be seen whether the process will be a success this time around.

In any mediation, both parties have to be willing to cooperate, open their eyes to common ground, and be willing to think creatively about how to resolve the dispute. Having a skilled mediator doesn’t hurt either.
